The protection of your personal data is very important to us. Therefore, we process your data exclusively on the basis of the legal regulations (DSGVO, TKG 2003). In this privacy policy we inform you about the most important aspects of data processing within the framework of our website.

When you visit our website, your IP address, start and end of the session will be recorded for the duration of this session. This is due to technical reasons and thus represents a legitimate interest in accordance with Art 6 Paragraph 1 lit f DSGVO. If nothing else is regulated in the following, these data will not be processed by us.

If you contact us via the form on the website or by e-mail, the data you provide will be stored by us for the purpose of processing your enquiry and in the event of follow-up questions. We will not pass on this data without your permission. All business correspondence as well as inquiries via the contact form will be stored for ten years.

Data storage

We would like to inform you that for the purpose of an easier shopping process and for the later contract processing, the IP data of the connection owner is stored by the webshop operator within the framework of cookies, as well as the name, address, e-mail address and, if applicable, credit card number of the buyer.

Furthermore, for the purpose of contract processing, all data that you provide us with in connection with your order will also be stored by us (such as name, address, type of shipment, order content). The data provided by you is necessary for the fulfilment of the contract or for the implementation of pre-contractual measures. Without this data we cannot close the contract with you. Data will not be transferred to third parties, with the exception of the transfer of credit card data to the processing bank institutes / payment service providers for the purpose of debiting the purchase price, to the transport company / shipping company commissioned by us for the delivery of the goods and to our tax advisor for the fulfilment of our tax obligations.

After cancellation of the purchase process, the data stored by us will be deleted. In the event of a contract being concluded, all data from the contractual relationship will be stored until the end of the tax law retention period (7 years). 

In addition, the data name, address, purchased goods and date of purchase are stored until the expiry of the product liability period (10 years).  The data processing is based on the legal provisions of § 96 (3) TKG as well as Art 6 (1) lit a (consent) and/or lit b (necessary for the performance of the contract) of the DSGVO. 

Cookies and web analysis

Our website uses so-called cookies. These are small text files that are stored on your end device with the help of the browser.

We use cookies to make our offer user-friendly. Some cookies remain stored on your terminal device until you delete them. They enable us to recognise your browser on your next visit.

If you do not wish this, you can set up your browser to inform you about the setting of cookies and to allow this only in individual cases.

If you deactivate cookies, the functionality of our website may be limited.

Our website uses functions of Google Analytics, a web analysis service of Google Inc. ("Google"), 1600 Amphitheatre Parkway, Mountain View, California, 94043, which uses cookies to help the website analyze how users use the site. The information collected or generated in this way is generally transferred to a Google server in the USA and stored there.

You can prevent this by setting up your browser so that no cookies are stored.

We have concluded a corresponding contract with Google for the processing of order data and Google has committed itself to comply with the applicable data protection regulations.

Your IP address is recorded, but immediately anonymized by cutting the last 8 bits or two digits of the IP address. Thus only a rough localization is possible.

The relationship with Google is based on the standard contractual clauses approved by the European Commission and, for the transfer of data from the EEA to the USA and other countries, where applicable, on the adequacy decisions issued by the European Commission with regard to the USA.

Data processing is carried out on the basis of the legal provisions of § 96 (3) TKG and Art 6 (1) lit a (consent) and/or lit f (legitimate interest) of the DSGVO.

Our purpose in terms of the DSGVO (legitimate interest) is the improvement of our offer and our web presence. Since the privacy of our users is important to us, the IP address transmitted is not combined with other data from Google.

The user data is stored for a period of 12 months.

Newsletter

You have the possibility to subscribe to our newsletter via our website. To do so, we need your e-mail address and your declaration that you agree to receive the newsletter.

You can cancel your subscription to the newsletter at any time. Please send your cancellation to the following e-mail address: office@mr-smart.at. We will then immediately delete your data in connection with the newsletter dispatch. This revocation does not affect the legality of the processing that took place on the basis of the agreement until the revocation.

Rights of affected persons

Regarding your data stored at our company, you are basically entitled to the rights of information, correction, deletion, restriction, data transferability, revocation and opposition.
